To Whom It May Concern, I am writing to formally complain about unauthorized hard inquiries made on my credit report by the following entities on XX/XX/2024 : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX- These hard inquiries appear on my credit report without my knowledge or consent, and I did not authorize any credit applications or services from these companies. Under the Fair Credit Reporting Act ( FCRA ), specifically 15 U.S.C. 1681b, credit inquiries can only be made with the explicit authorization of the consumer or for a permissible purpose defined by law. These inquiries do not meet these criteria and, therefore, must be removed from my credit report immediately.
Additionally, under FCRA 15 U.S.C. 1681c ( a ) ( 2 ), credit bureaus are required to report accurate information. The presence of these unauthorized inquiries is a clear violation of this provision, as they inaccurately reflect my credit activity.
Furthermore, under FCRA 15 U.S.C. 1681i ( a ) ( 1 ), I have the right to dispute inaccurate or incomplete information on my credit report, and the credit reporting agencies are required to investigate and correct any inaccuracies within 30 days. Given the unauthorized nature of these inquiries, I demand their immediate removal from my credit report.
Failure to address this matter promptly will result in further action, including the possibility of pursuing legal action for damages under FCRA 15 U.S.C. 1681n, which provides for penalties for willful noncompliance with the Act.
I request that you take immediate action to remove these unauthorized hard inquiries and provide me with written confirmation that they have been deleted from my credit report.

" The Fair Credit Reporting Act ( 15 U.S. Code 1681 ) says ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system.
So whenever there is a violation under the FCRA, it impairs the efficiency of the banking system. This is a violation of TILA US Code 1666B since I was never late.
I recently reviewed my consumer report and noticed an incorrect late payment record on my XXXX XXXX XXXX XXXXXXXX. I have always maintained timely payments on this account. Under the Fair Credit Billing Act ( FCBA ) and the Truth in Lending Act ( TILA ), creditors are required to accurately report consumer transactions and provide a mechanism for correcting errors in a timely manner. Please conduct an investigation into this matter, and if you can not provide documentary evidence of these supposed late payments, I demand these payments to be updated to on time as they should be as I was NEVER late. I expect these updates to be made promptly, in compliance with the law.

We have done business with Capital One for a long time and never had any problems .... until we did. My husband has been fighting with XXXX for his XXXX benefits following an accident that left him without the use of his arms. This process took 3 years. He was finally approved in XXXX, 2024. He was granted full favorable decision and back pay for the 3 years he couldn't work. Back pay was issued via check for {$49000.00} and we deposited it into our Capital One Checking account via ATM at the Capital One XXXX on XX/XX/XXXX. We knew that there would be a reasonable hold because of the amount. At most we expected 3 day. NOT 2 MONTHS!
On XX/XX/XXXX we both received an email to call the bank, funds frozen until XX/XX/year> for suspected fraud. We finally were able to speak with a supervisor/investigator he said they couldn't verify the validity of the check. The {$49000.00} check from the XXXX Treasury. He said that he " knows '' the check is fake and we are committing fraud and threatened legal actions ... jail. I find it hard to believe that they don't have any way to verify this check. I used the online verification system on XX/XX/XXXX and I called the Treasury myself and the agent verified that the check was paid/funded on XX/XX/XXXX. The check cleared and still Capital One would not release the funds. After much fighting and getting help from our Senator the funds were made available. Fast forward to XX/XX/XXXX and I had a declined charge. Back on the phone with Capital One because the account is frozen... again. More fighting and the next day they were available ( no explanation or apology ). Fast forward to XX/XX/XXXX and the account is frozen again. I got on the phone with Capital One again, they were all very rude, accusatory and once again told us we were trying to commit fraud and threatened legal actions. I spoke with many people and everyone has a different story. They told us that my husband has to prove that he is XXXX to Capital One. One said the IRS told them it was fraudulent. One said they still haven't verified the check. The one that was paid/cleared on XX/XX/XXXX. Multiple phone calls, crying, begging and we can't access our funds. I can't access the funds either because it's a joint account. All the bills we paid are electronic transactions. This means they are all going to be declined and then we have the fees. It's really stressful.
My husband 's first monthly benefit was direct deposited into the frozen account.
This never should have happened. The accusations, the lack of professionalism, terrible customer service, illegal holds of fund 's for absolutely nothing. Capital One release the funds.

On Sunday XX/XX/XXXX at approximately XXXX EST I made a deposit of {$4700.00} dollars into my Capital One checking account. It was XXXX XXXX dollar bills and XXXX XXXX dollar bills for a total of {$4700.00} dollars. I inserted the money into the ATM like usual and then an error popped up on the screen saying they were having trouble processing the transaction. After that the ATM prompted me to take my card back and another message popped up saying " have a good day ''. I never received any receipt for this transaction and the ATM never returned my money I put in. I made sure to not go anywhere and quickly contacted Capital One support to make a claim so I could have some sort of record of what happened. Unfortunately it was a Sunday and the bank was closed so there was no bank manager I could contact about the situation. If the bank checks the ATM they will clearly see there is {$4700.00} dollars too much in the ATM. I wasn't able to take any videos or pictures of the messages because it all happened so fast. Long story short I put {$4700.00} dollars in the ATM and my transaction wasn't processed and my money wasn't returned.
