Complaint: Please accept this formal complaint against Hancock Whitney Bank headquartered at XXXX XXXX XXXX, XXXX MS XXXX. This bank is engaged in unlawful practices and predatory lending which undermines the financial sanctity of our society. I am a victim of Hancock Whitney Banks unethical, immoral, and illegal handling of me as a former customer as outlined in this missive.
I pray that you investigate and take all appropriate action in this matter.
The above subject matter is in reference to an unfair and erroneous reporting for Account Number XXXX in which Hancock Whitney served as a lender and as I the borrower.
On XX/XX/XXXX, I purchased a XXXX XXXX of unspecified VIN Number from XXXX XXXX, the Original Seller, of address XXXX XXXX XXXX, XXXX, LA XXXX. As it turned out, the car had several manufacturing defects. Despite my requests to have it fixed sometime in XX/XX/XXXX, the dealership refused to heed to my plea. This is even though I had in place an extended warranty bought in XX/XX/XXXX through the Hancock Whitney Bank which also happens to be the bank through which I was financing the transaction using the abovementioned account number. Since the dealership refused to fix the car, which was in breach of our agreement, I had no other option but to stop the payments. Consequently, the bank repossessed the car on XX/XX/XXXX, and sold it to another buyer in XX/XX/XXXX without any notice given to me, in contravention of the law. Since then, I have continued to bear the financial burden of a vehicle that was repossessed by the bank because of their erroneous and unfair credit reporting.
Under Louisiana Revised Statutes Tit. 10, 9-611 ( 2017 ) and State RISA and MVISA statutes, a deficiency can not be claimed unless all of the required notices were properly and timely given, and all of the allowable redemption and cure time limits were adhered to. On the other hand, the Fair Credit Reporting Act, 602 ( 15 U.S.C. 1681 ) provides that the banking system is dependent upon fair and accurate reporting since inaccurate credit reports directly impair the efficiency of the banking system while unfair credit reporting methods undermine the public confidence.
It is based on their continued unfair and erroneous reporting of the above named account and their contravention of the above laws that I have written to them in the past, including a letter addressed to the Bank on XX/XX/XXXX, which was returned to me as not deliverable. In the letter, I specifically requested that Hancock Whitney investigate as outlined in 15 U.S.C. 1681s-2 and demanded a full account validation and requested that pursuant to Louisiana Revised Statutes Tit. 9. 3571.1, the validation be in the form of a notarized statement with a person with the knowledge of the debt. Additionally, I requested that Hancock Whitney Bank send me an explanation of the methods used, and the description of the records reviewed in the process of the investigation. All my efforts proved futile because of their refusal and/or failure to accept my letters requesting proofs.

I have been using Hancock Bank for over 50 years, and [-] service has gotten very poor. I have been trying to set up [-] online banking. After 3 trips to [-] local branch and 4 calls to customer service, no one was able to help [-]. I think it is time to change banks.

I want to commend [-] woman located in [-] Alabama customer service office who helped [-] figure out [-] to log into [-] account. I regret that I didn't write down her name. She was professional but friendly and was very patient and helpful throughout [-] call, which lasted for quite awhile. Unfortunately I accidently cut off [-] call before I could thank her. As a customer of [-] Hancock [-] Bank, I have always experienced pleasant, helpful service both in person and on [-] and am very grateful. However this morning [-] Customer Service operator went above and beyond to be helpful.

Too [-] to give written explanation of [-] royally screwed up your bank account processing services of [-] simplest transactions. I was in banking 30 years. I was SVP/CIO for 22 years. In charge of deposit operations in [-]

[-] opinion this company tries to make thing difficult to use your money for little of nothing. I have to fly from [-] home in Washington state to Opelousas, [-] to transfer money from matured cd’s to [-] checking account. Yup, they give you 10 days to [-] something with [-] money or it [-] be reinvested at about 1/10th of 1 percent, yes .14%. And they [-] charge you 2% of money withdrawn from account before maturity in 21 months. They [-] not answer phones, return phone calls either. Closing all [-] accounts with them, [-] cost [-] several hundred dollars to fly from Washington state to Louisiana to deal with this attempt to use [-] money for almost 2 years and pay [-] little or nothing.
